This is just stupid!

I guess these 31 law schools want our military to dwindle. They are attempting to ban recruiters from working on campuses, which is where I was confronted to join the military nine years ago. At any rate, I'll let you form your own opinion, but if you want mine, we should send a squad of these lawyers into Iraq and ask them if we could maintain operations with our Army's current size... not that size matters.

WASHINGTON - The Supreme Court said Monday that it will settle a pivotal battle over whether colleges can ban military recruiters from campuses without losing federal funds.
The case pits free speech and academic freedom against the power of the purse and the need for a strong national defense.
A coalition of 31 law schools says forcing them to accommodate military recruiters also forces them to endorse the Pentagon's discrimination against gays and lesbians, at odds with the schools' anti-discrimination policies.
They say a 1994 law that threatens to cut federal funding for colleges that ban military recruiters violates their rights to choose what ideas they embrace or support. Other employers who discriminate are also banned from recruiting.
The Third Circuit Court of Appeals in Philadelphia agreed with the law schools and declared the law unconstitutional.
But the government says the law, known popularly as the Solomon Amendment, is an essential tool for "effective recruitment ... to sustain an all-volunteer military, particularly at a time of war."
Government lawyers say the measure doesn't violate the law schools' free-speech rights because it doesn't force them to allow recruiters. They can bar them and forgo federal funds.
The case arises at least partly because of an increased need for recruitment after 9-11.
The law has existed since 1994, and most colleges had worked out compromises, neither banning military recruiters nor giving them the kind of choice access reserved for favored employers. Often, military recruiters were denied assistance from placement offices or excluded from some recruiting events.
But after 9-11 and with wars in Afghanistan and Iraq, the government began to demand that law schools give military recruiters the same access as other employers. In 2004, Congress amended the law to that effect.
The court will hear the case in the fall and likely decide it by June 2006.

Interesting issue...
I'm a little hung up on the fact that they're using discriminatory employment practices as reason for denying access.
Might it not be time to at least think about ending the denial that gays and lesbians are in the military and have been forever? I mean, if "don't ask, don't tell" isn't just us sitting around like the three monkeys then what is it?

"Not that size matters"...... hahaha......very funny, Casanova. I just read an editorial from some guy in the Dallas Morning News stating that he doesn't think we need a strong military. He thinks it sends the wrong message to the world......what message would that be......hmmmm......"don't f*@k with us or we'll stomp you". Being strong doesn't mean that you're looking for a fight, it just means that you'll finish it if one starts. Thank goodness we have people like you and all our other "volunteers" that are willing to make our country strong.

This is my first comment on this blog. Nice to see you back!

As to always question's point about gays in the military, there was an article with a great response to this problem. Can't remember who it was but I think it was a Yale Law School professor. Anyway, he brought up the point about affirmative action and how it hurts asian students. They do too well so somehow it's okay to keep quotas on the number of asian students accepted. Is this fair? The military could easily bring this issue up too.

I think the Colleges don't have a legal leg to stand on. After all, if they want to bar recuiters, they can decline federal funds.

Smik, I'd clean that rather lengthy, off topic comment and save yourself some bandwidth.

Back to the issue...of course this is a smokescreen. You can bet your bottom dollar that the law school's would make some other claim as to why they could not extend the same recruitment opportunity to the military as any other organization.

One thing, though, to think about. If the law schools don't permit recruiting, then maybe there will be fewer lawyers in the military. Then, maybe the paperwork load and ridiculous rules of engagement will be reduced. Sure. Maybe. Riiiiight.

I am pressuring the Sharon Government, publicly and through others because that is where this mess and terrorists got their birth into hating us so much what they will commit suicide just to kill us.

With my over 30 years of experience, mostly in the Middle East and Europe; I was in Baghdad twice; 3 years before you.

Until we can get Muslim boots on the ground from other countries to stand with you; I can not see a way out.


I lived through it and I am working so you will live through it; to get you all home winners in your Mission in Iraq.

The truth has to be talked for Your Sake! or you and President Bush do not have any chance of anytime in the near future of finishing our Mission in Iraq as winners.

I can not read that either; but what is important 75% of the Jews in Israel want peace; that is why I included it from my Gush Shalom Peace group's email.

First…I understand that my comment is not directly on point… As an unapologetic neo-con attorney (alright I am sorry about the lawyer bit) I am disturbed by the ever encroaching and incestuous role of the ACLU's influence on America's social, political and legal landscapes. While at its inception the ACLU may have been an organization intended to protect our constitutional guarantees, through activist courts and well funded private backers, it is now able to effectively advance its dangerous, selectivist agenda. Such as…

The ACLU is defending pro bono the North American Man-Boy Love Association (yeah it is just what it sounds like) because they claim child molesters have a constitutional right to coach children on how to defend themselves from…well child molesters. The ACLU also is notorious for suing ill-funded school boards ad nausea if they believe a county permits Christian-based ideas within its walls; e.g. using the word "Christmas Holiday" on a school calendar recently sent a team of ACLU lawyers on a Georgia school district like great whites on a bleeding seal...

When I get angry thinking about these things though I remind myself that the ACLU, the 9th circuit court, Michael Moore, etc. all exist because as a democracy Americans want it this way... and as much as it bothers me, it isn't going to change until it bothers the majority of Americans enough too. I hardly think preventing recruiters from going on to school campuses is going to make the military "dwindle." Please! Probably, better job opportunities for poor young people would do more harm. (And check it, kids in law school aren't going to sign up for $200 a month when they can make five hundred an hour when they graduate.)

Many kids, after all, are suckered into the military by promises of a better education and signing bonuses. They find out about the killing and dying part once they've signed on the dotted line.

I think schools should be able to make whatever rules they want on this issue. The gays in the military thing is beside the point. It's really about the military taking advantage of a captive audience full of impressional minds. If the military is such a great deal for 19 year-olds, why don't the recruiters just sit back and wait for the them roll in to sign up.

I thought the right wing types were all about the government getting off everyone's backs? Now, the argument is the government can walk on to a school campus and propagandise the students?

Kids should at least know what they're getting into when they sign up, but how could they?

Marine General Smedley Butler should be required reading for those tageted by the recruiters. They should hear it from someone who knows what its all about.

And what is this bill?

sorry Casanova, but I have to address one of your commenters. Bushmeister......I resent your comment that only poor young people enlist in the military because they can't find a job, and I also resent your implication that only suckers sign up, and that they are apparently too stupid to know that they may go to war and be shot at when they sign on the dotted line. I have two sons in the military and neither is poor or stupid. They have both grown and matured during their time in the service and haven't regretted their commitment to their country for a minute. As a matter of fact, both have reinlisted. I'm extremely proud of them and all our other service men and women, as you should be too. You're right about one thing, though...... colleges should be able to stop recruiters from coming on their campus, but the federal government should be able to stop giving them money also.

Definitely not time to recruit more brilliant young people and turn them into human cannon fodder to serve the interests of the elites.

This war is not making America strong. It is making us WEAKER and WEAKER in all kinds of ways.

Where is Osama Bin Laden? What happened to THAT? Was Al Queida ever even real? How can they still claim the Iraq War has ANYTHING AT ALL to do with 911, when that has been proven to be an out and out fabrication? This was planned well before 911. I assume you all know about PNAC, the Project for a New American Century. Right? RIGHT?!

Does anyone here call themself a Christian? All so-called Christians please stand up and identify yourselves. Ok, great. What does your religion teach you? What are the tenets upon which it is based? Have them in your head? Good. Now tell me how it is possible to favor this war or be involved with it in anyway and still call yourself a Christian? Does anyone here see how the so-called Christian Right is not Christian at all?

Anyone in the room call yourself a conservative? Oh really? GREAT! Cause I do too. And as you can tell I do not believe this war should continue. As a true conservative (not a neo-con) I believe that federal government must remain (a) open and honest with us so we the people know what its true motives are, and (b) out of our hair so that it ensure that we are free. The "Patriot" Act makes you less free--read it--know what it is about. The executive orders related to FEMA make you less free--do you know what those are? A government (and people--like I'm guessing many of you) who will not listen to criticism and engage in honest debate--THAT is the worst of all. Listen--they WANT you unquestioning "patriotism", they WANT you to not think and act as individuals, they WANT you to approve of their organization of force, they WANT you to be unarmed and complient.

Two suggestions--(1) read Orwell's 1984. I thought I knew what this book was about and then I actually read it. It was an AMAZING, ENGAGING read. Trust me, you will love it.

(2) Time to quit watching TV news... dog and pony shows like the one the other day with the phony "conversation" with the troops...the Sgt. Maj. was a PR flack...you know that right? Look at alternative news sources that might scare you at first--just to see what's there--keep and open mind. I suggest:
